I, the applicant named above, hereby confirm that I have voluntarily agreed to provide my labor services and assistance to Arizona Students Recycling Used Technology (AZ StRUT) in connection with their computer refurbishing and recycling program.
I understand that I will not be compensated for my work and that AZ StRUT will not provide any medical, workman's compensation or liability insurance coverage should I be injured while providing my labor. I recognize the inherent risk of physical injury to myself and to my property, should I provide any, that could result from participating as a volunteer or while traveling to and from, the designated job site with AZ StRUT. I am volunteering and agree for myself, my heirs, assigns, and executors to hold AZ StRUT, its officers, directors, employees, agents and volunteers harmless and do hereby waive any claims which may hereafter accrue to or be initiated against AZ StRUT, its officers, directors, employees, agents and volunteers for any bodily injury, including death, or injury and/or damage to my property incurred by or to me while performing as a volunteer for AZ StRUT.
IN CONSIDERATION OF MY VOLUNTEER APPLICATION, I hereby agree to be bound by the terms of this release and take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
I HEREBY WAIVE, RELEASE AND DISCHARGE AZ StRUT and/or its officers, directors, employees, agents, representatives and activity or event volunteers from any and all liability, including but not limited to, liability arising out of negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me or my property.
I HEREBY AGREE TO INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO PURSUE LEGAL ACTION against the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of my participation in the AZ StRUT volunteer project.
I acknowledge that there is always a possibility of damage to me and/or my personal property and possibility of personal injury to me or other members of my family regardless of how well supervised the project is and I agree to assume any and all of these risks.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my minor(s) and I may be exposed to or infected by participating in AZ StRUT volunteer work and that such exposure could result in personal injury, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at AZ StRUT may result from actions, omissions, or negligence of myself and others, including, but not limited to, AZ StRUT employees, volunteers and participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my minor(s) or myself, including but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense of any kind, that I and/or my minor(s) may experience or incur in connection with AZ StRUT. On my behalf, and on behalf of my minor(s), I hereby release, covenant not to sue, discharge, and hold harmless AZ StRUT, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or related thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of AZ StRUT, its employees, and representatives, whether a COVID-19 infection occurs before, during, or after participation with AZ StRUT.
